DA: Mass. dad shoots 2 kids, 1 fatally, kills self

(AP) ? A man who had recently separated from his wife shot his two children, killing his 7-year-old daughter, before committing suicide, prosecutors said.

A family member called police Saturday night after finding the bodies of 41-year-old Daryl Benway and his daughter, Abigail, in the master bedroom of their two-story Oxford home, Worcester County District Attorney Joseph Early Jr. said. Benway's 9-year-old son, Owen, was found shot in the head in the kitchen and was taken to UMass Memorial Children's Medical Center in serious condition.

Benway's wife, Kelleen, returned home after the shootings, unaware of what had happened, and found a swarm of police cruisers and television crews, Early said. She was taken to the children's hospital, where authorities told her the fates of her children and husband.

Neighbors told the Telegram & Gazette that Daryl Benway's brother Shawn lived on the first floor of the home with his wife and mother. Shawn Benway called 911 to report the shootings, Early said.

Daryl and Kelleen Benway separated three or four weeks ago but were still married, Early said. He said he couldn't speculate on a motive.

No restraining orders had been filed against Daryl Benway, and he had no criminal record, the DA said. He had a gun license that expired in 1999, Early said.

"It doesn't get much worse than this," Early said. "It's a horrible scene, a horrible situation."

On Daryl Benway's Facebook page, his profile picture posted December 2011 showed him with his family in front of a Christmas tree. He described the woman next to him as "my Beautiful wife Kelleen." Owen stood in front of him in a white dress shirt and red plaid tie, while brown-haired Abigail wore a black and white dress with a black hair bow.

Daryl Benway listed his place of employment as TJX Cos., which operates discount retailers TJ Maxx, Marshalls and HomeGoods, as well as Ross Stores Inc.

Sue Brennan, who lives behind the Benways, said Daryl Benway always seemed easy-going.

"He's the most happy-go-lucky guy I know. I just don't see him doing that," Brennan, 47, told the Boston Globe.

Michael Courtemanche, of Webster, said he grew up with Benway and although he hadn't spoken to him much over the past 10 years, he saw him just three days ago.

"They were excellent, a good family," Courtemanche, 40, told the newspaper. "Just like any other family, they had problems. But Daryl was always friendly, always in a good mood."

Russia speeds law on rights groups, snubbing U.S

MOSCOW (Reuters) - The Russian government rushed a law through parliament on Friday which will tighten controls on civil rights groups and has strained relations with the United States, which fears a crackdown on opponents of President Vladimir Putin.

In defiance of criticism this week from the U.S. State Department, curtly dismissed by Russia's Foreign Ministry as "gross interference", the lower house overwhelmingly backed the bill in second and third readings under accelerated procedures.

The rapid passage underlined the importance Putin attaches to a law which will force foreign-funded non-governmental organizations (NGOs) that engage in "political activity" to register with the Justice Ministry as "foreign agents" and to file a report on their operations to officials twice a year.

Critics say the term "foreign agents" echoes back to the Cold War, and that organizations which carry the tag will be seen by many Russians as traitors. They say it aims to starve such groups of funds and to intimidate them into silence.

"The law is harmful to the process of developing a civil society. It does not support the opening up of our country," Yelena Zhemkova, a director at Russian human rights group Memorial, told Reuters. "Put simply, this law has just one goal and that is to provide a formal reason for labeling your opponents enemies of the state."

Boris Nemtsov, a former minister and one of the organizers of protests against the president, said: "The law was inspired and pushed by Putin himself as a repressive law on rallies."

Putin, a former KGB spy, has been in power for 12 years as prime minister or president. He returned to the Kremlin in May and could rule the world's largest country for the next 12 years if he is re-elected in 2018.

In the past seven months he has faced the biggest protests since he first rose to power and he has already pushed through a law that increased potential fines for demonstrators, while police have raided the homes of some of the protest organizers.

Parliament is also considering a new law tightening controls on the Internet, used by the opposition for distributing news about protests, as well as legislation tightening defamation laws, which the opposition fears could also be used against it.

U.S. CRITICISM

The U.S. State department expressed its "deep concern" about the NGO law on Wednesday but the Russian Foreign Ministry hit back shortly after the State Duma lower house approved the law.

In a response that showed the impact the bill is having on already frayed foreign relations, it said in a statement: "We note that such comments cannot be seen as anything other than entirely inappropriate attempts at gross interference in the activities of the Russian state authorities."

Putin's United Russia party says the law, which had its first reading in the Duma only a week ago is needed to protect openness about NGOs.

"This law is no limitation to anything whatsoever. It just makes information public so it is in the best interest of civil society and is not against anybody," the party's Irina Yarovaya, co-author of the bill, said before it was presented. "There is nothing derogatory in the phrase 'foreign agents'."

The second and third readings of the bill were rolled into one, and the law was approved with just three votes against. It will go into effect once the upper house has rubber stamped it and Putin has signed it into law.

WIDER CRACKDOWN

Critics see it as part of a wider crackdown on civil liberties and the opposition movement protesting against Putin.

They say the law could put at risk the work of organizations such as Amnesty International, which campaigns for human rights, and Transparency International, a corruption watchdog.

The Russian rights group Golos, which receives foreign funding and compiled allegations of fraud in the parliamentary election won by United Russia last December, says it believes it is the prime target of the law.

The Moscow Helsinki Group, which has been monitoring human rights since Soviet times, has said it will give up all foreign funding once the law takes effect, but will not halt its work.

"The Duma, in some sort of extraordinary speedy mode, has been accepting laws lately, on the Internet and others, instead of dealing with real problems like the economic crisis," Memorial's Zhemkova said.

A U.S. State Department spokesman said on Wednesday that the United States had communicated its concern to Moscow over the law, which could make already chilly ties between the former Cold War enemies even frostier.

The United States places its own limits on foreign-funded groups on its own soil through the Foreign Agents Registration Act. It requires groups acting as the agents of foreign governments in a political capacity to disclose their activities and finances.

United Russia has highlighted similarities between the new law and legislation in the West, but the State Department said the Russian law goes further than its U.S. counterpart.

Putin accused Western governments last year of trying to influence the December election by funding NGOs in Russia, and Golos was accused in a television documentary of supporting opposition parties. Golos has denied this.

Putin once referred to NGOs as "jackals" because some of them count on foreign support. The Kremlin's advisory human rights council had called for passage of the new law to be delayed but Putin dismissed their calls.

    People get involved in The Color Run each year as they are looking for something other than a normal race. More and more people can take part in this race since it takes place in more than 25 locations throughout the US. This race is developed to brighten a runner's day, and during the process a local charity is benefitted. Those who want to take part in the occasion can be racers or volunteer to work on the crew. In either case, participants are sure to have a colorful day.

    People will come to the event on race day wearing basic white shirts and big smiles on their faces. Once the race starts, runners will go as fast as they can across the starting line. As they go through the race, their shirts will no longer be white since they will be bombarded with colors in each section. Their white shirts will now adorn yellow, blue, purple, green, and pink colors as they have colored corn starch thrown at them throughout the race. Along with eye defense from the sun, racers should wear sunglasses as a form of protection from the flying corn starch.

    People who are not able to participate in the Color Run as a racer can be involved as a volunteer. The runners have to have someone there to throw colors at them throughout the race. Volunteers get the honor of throwing colored corn starch at all of the racers that pass them by. Not only is it enjoyable, but it is a great way to get rid of the aggravation of not being able to race. Volunteers will receive an exclusive t-shirt for participating, but they will not be compensated for the work that they do. Some of the money from racer registration is portioned out and contributed to a charity in the local area.

    Once racers have completed the 5K run and crossed the finish line, they will continue to bombard one other with colored corn starch in celebration. After the race is over, the party will continue with food and music for the rest of the day. You don't have to be involved in the race or volunteer to go to the celebration. The function is available for everyone to attend.

    The Color Run is sure to brighten anyone's day and make running a race a fascinating experience. With over 25 different cities to pick from, there is sure to be one in your area. You can get rainbow tinted from head to toe, and when you're done you can relax with the other racers while enjoying great food and awesome music.

    Ouya Attempts Gaming Console Revolution, Develops $99Android ...

    OUYA Android Gaming Platform

    Startup OUYA wants to take gaming to a whole new level and they plan to reach their goal by offering a $99 gaming console that is based solely on the Google Android operating system.

    OUYA?s system will be open to any developer which means it can be hacked to add new features and device support as required.

    The new platform is currently listed as a?Kickstarter project?and the company set a goal to raise $1 million to get off the ground. Extra money raised by OUYA will be use those funds to develop new Android-based games for the platform.

    The systems open source development could help it quickly gain a developer following, app creators often like to tinker with new systems and see what they can create, when that platform has the chance to attract an entirely new audience to their work developers tend to adopt the technology very quickly.

    Not only will OUYA offer a ton of Android applications, it will carry a bunch of games users can play for free while relying on in-app purchases to turn a profit.

    Because the $99 gaming console is based on Android it will also have other features which will be added at the time of launch and likely developed by app creators looking to turn the system into a home multimedia offering with plenty of new features.

    The system will also look amazing thanks to a design handled by Yves Behar, a PayPal and Jawbone designer with a flair for creating beautifully crafted devices.

    Julie Uhrman, CEO of OUYA listed some of the platforms specs for Business Insider:

    (AP) ? A train that partly derailed and exploded north of downtown was traveling below the recommended speed before the crash, and its operators noticed no problems with the track as they approached the curve where it happened, a National Transportation Safety Board representative said.

    The NTSB is looking into what caused the Wednesday derailment on Norfolk Southern Corp. tracks north of downtown Columbus, which led to spectacular explosions and the burning of three tank cars, each carrying 30,000 gallons of ethanol.

    Authorities said they decided to let the tankers burn for a while and then spray chemical foam to prevent the blaze from re-igniting.

    The smoldering fire extinguished early Thursday morning, and Norfolk Southern has begun moving cars away from the scene, a company spokesman said.

    Investigators are reconstructing the rails in hopes of spotting any problems. The full investigation could take a year.

    "In an investigation of this sort, we try to look at everything, but at this point, the speed was where it was supposed to be coming into the curve, and there were no apparent anomalies that the crew noticed coming up on that curve," NTSB member Earl Weener said late Wednesday.

    The track had been visually inspected Monday, as it is twice a week, and had undergone more thorough testing in April, one of three such inspections each year, Weener said.

    The 98-car-freight train was traveling from Chicago to Linwood, N.C., Norfolk Southern spokesman Dave Pidgeon said. In all, 16 cars went off the tracks.

    Nobody aboard the train was hurt, but two people suffered minor injuries while walking along the tracks to investigate when an explosion occurred, authorities said.

    Columbus Mayor Michael Coleman and public safety officials said they were grateful the accident occurred in the middle of the night, away from more populated areas. About 100 residents within a 1-mile radius were evacuated but were able to return later Wednesday.

    The Columbus crash was unusual because it occurred on main line tracks, instead of more common derailment sites such as rail yards or industrial facilities, Federal Railroad Administration spokesman Warren Flatau said.

    Of the 389 derailments in the U.S. in the first four months of 2012, 96 were on main lines, Flatau said. There were 22 in Ohio, four of them on main lines in Huron, Lorain, Fairfield and Sandusky counties.

    Last year, 419 of the total 1,451 derailments nationwide were on main lines. Ohio had 65 derailments; a dozen were main-line.

    Federal Railroad Administration data show Norfolk Southern to have the fewest number of accidents and reported incidents over the past decade of the four major freight carriers that operate on U.S. rails. The company's reported number of train accidents on main lines since 2001 ? 695 ? is also the fewest of the four major carriers, the statistics show.

    Of those major lines, Union Pacific reported 2,019 accidents on main lines during that period, followed by BNSF Railway Co. (1,781), and CSX Corp. (1,005).

    Flatau said Norfolk Southern and CSX primarily serve the eastern United States, with BNSF and Union Pacific serving the west.

    Roughly 29.4 million carloads of freight are hauled every year across 140,000-plus miles of rail in the United States, according to the American Association of Railroads.
